General Terms and Conditions

GENERAL TERMS OF:

Art. 1. These General Terms and Conditions are intended to regulate the relations between OSM EUROPE Ltd., with BULSTAT Unified Identification Code 204242654 and registered address: 77 Prilep Str., Varna, Bulgaria, hereinafter referred to as the PROVIDER, and the customers, hereinafter referred to as the USERS, of https://osmbulgaria.com/en/.

III. FEATURES OF THE PLATFORM

Art. 3. https://osmbulgaria.com/en/ is an online space where Users can learn about the Provider’s activities and the services it offers. They can:

  1. share their contact details by using the contact form on the Provider’s website;
  2. use the website to contact the Provider and find out more information;
  3. place enquiries about services, incl. making orders, via the contact form;
  4. receive email information about news related to the activity of the Provider;
  5. be notified of the rights arising from the law, primarily through the interface of the osmbulgaria.com platform on the Internet;
  6. exercise their right to opt out, where applicable, under the Consumer Protection Act.

Art. 4. The Provider guarantees the rights of the Users provided for by law, within the framework of conscientiousness, accepted in practice, consumer or commercial law criteria and conditions.

Art. 5. In order to use osmbulgaria.com/en/, the User can use the contact form page and leave their contact details such as name, email and phone number so that they can obtain further information on the Provider’s services, including making orders.

By entering their name and contact details, they would be considered to have accepted these General Terms and Conditions.

The osmbulgaria.com/en/ is also accessible for the User using their Facebook or Google accounts; the User must also declare that they are familiar with these General Terms and Conditions, agree with their content and oblige to unconditionally abide by them.

In cases where the User has entered an enquiry for the Provider via the contact form or used their Facebook or Google accounts to register on the website, the Provider confirms the User’s registration by sending a confirmation to the email address specified by the User. The contact details of the User are stored, as a result of which contractual relations arise between them and the Provider.

When providing their details on the Provider’s website, the User undertakes to share correct and up-to-date data.

  1. PROTECTION OF PERSONAL DATA

Art. 6. The Provider implements the measures for the protection of the User’s personal data in line with the European Regulation (EC) 2016/679 of the European Parliament and of the Council of April 27, 2016 regarding the protection of physical individuals in relation to the processing of personal data and the free movement of such data and for the repeal of Directive 95/46/EO (GDR) and the Law on the Protection of Personal Data. The Provider processes the personal data of the Users in accordance with Art. 6, para. 1, b. ‘b’ of GDPR – the processing is necessary for the execution of the contract, following which the data is obtained or on the basis of Art. 6, para. 1, b. ‘a’ of the GDPR – based on the User’s express consent.

The Provider has published the information about the personal data it processes and the purposes for which it is used, and all the information required by the Regulation (EC) 2016/ 679 of the European Parliament and of the Council of April 27, 2016 on the protection of physical individuals in relation to the processing of personal data and the immediate free movement of such data and for the repeal of Directive 95/46/EO (GDPR) in the Privacy Policy, which is an integral part of the General Terms and Conditions.

For security reasons relating to the Users’ personal data, the Provider of the osmbulgaria.com/en/ platform will send the information only to the email address that was specified by the Users at the time of them contacting the Provider.

The Provider of the osmbulgaria.com/en/ platform has the right to store data in the final communication device of the User, unless the latter explicitly expresses their disagreement to this.

The website processes the User’s personal data for the purposes of direct mapping only for their regular use, which they can withdraw at any time.

The User acknowledges that the Provider may send emails and electronic messages regarding the delivery of the product, the completion of the functionality, the promotional announcements to the end User and other matters related to the execution of the contract.

Art. 7. At any time, the Provider on the osmbulgaria.com platform has the right to require the User to establish their identity and to confirm the authenticity of each of the circumstances and personal data outlined during the point of contact.

  1. AMENDMENT AND ACCESS TO THE TERMS AND CONDITIONS

Art. 8. These General Terms and Conditions may be amended by the Provider of the osmbulgaria.com/en/ platform, in such circumstances the latter will notify all Users, who have shared their contact details, in an appropriate manner.

The Provider and the User agree that any addition and amendment to these General Terms and Conditions will have an impact on the User in one of the following cases:

  1. after being expressly notified by the Provider of the com/en/ platform and if the User does not state within the 14-day period granted to them that they reject them; or
  2. after their publication on the Provider’s website of the com/en/ platform and if the User does not state within 14 days of their publication that they reject them; or
  3. with its explicit acceptance by the User through their profile on the Provider’s com/en/ platform.

The User agrees that all statements of the Provider of the osmbulgaria.com/en/ platform, related to the amendment of these General Terms and Conditions, will be sent to the email address specified by the User during the point of contact. The User agrees that emails sent pursuant to this article do not need to be signed with an electronic signature in order to be effective against them.

Art. 9. The Supplier publishes these General Terms and Conditions on together with all additions and amendments to them.

VII. TERMINATION

Art. 10. The current general Terms and Conditions and the User’s contract with the Provider on the osmbulgaria.com/en/ platform are terminated in the following cases:

  • upon termination and declaration of liquidation or declaration of bankruptcy of one of the parties to the contract;
  • by mutual agreement of the parties in writing.

Art. 11. To matters not settled in this contract, related to the implementation and interpretation of this contract, the laws of the Republic of Bulgaria shall apply.

Art. 12. These General Terms and Conditions enter into force for all Users on 01.11.2022.
